Our Divorce Process in 3 Simple Steps
We will prepare all the necessary legal documents for you and provide you with a draft for your review. After review and approval, your documents will require signature and notarization, if applicable. Next, your paperwork will be filed with the appropriate court and served to the other party, if necessary.
1.Prepare, Review, and Sign
Once a contract is signed and payment is received, we will prepare your divorce petition. We'll draft documents that will be emailed to you for review and approval. If no corrections are required, you will proceed by signing the documents.
2. Court Filing
Once the summons and complaint are signed, they will be filed at the courthouse. Copies of the filed documents will be returned to you via email. Hard copies will also be mailed to you for your records. It is vitally important to keep copies.
3. Serving the Other Party
The other party must be personally served with a copy of the summons and complaint. This means someone must hand-deliver the documents to the defendant in person. The defendant can be served anywhere – at home, at work, etc
Spouse Agreees to Sign
In the state of Nevada as long as you and your spouse both agree to the divorce you can file a Joint Petition for Divorce. When both spouses agree to all of the terms surrounding their divorce it is called an “uncontested divorce”
Spouse Refuses to Sign
If your spouse is refusing to sign the divorce papers, the action is considered a "contested divorce". If your spouse refuses to respond to a petition for divorce, the spouse will “default" and service by publication will be required.
Are Children Involved?
If you have a minor child(ren), you are required to take COPE classes prior to the judge approving your divorce in Clark County. The classes can be done online and cost about $50. The completion certificate must be filed in court.
